Changing the composition of a panel in the First-tier Tribunal (Special Educational Needs & Disability)

On 21 July 2014 the Senior President of Tribunals issued the conclusion of a pilot to test the composition of a panel hearing appeals in the First-tier Tribunal from three members to two members.

The pilot ran from October 2013 to April 2014 and was restricted to appeals against a local authority’s refusal to assess cases. Judges and members used on the two person panels were ones with considerable sitting experience.

Due to the success of the pilot hearings by two panel members will be extended to all refusal to assess cases in the First-tier Tribunal on a permanent basis with immediate effect.

The Senior President of Tribunals is also considering extending two panel member hearings to all appeals to the First-tier Tribunal. In accordance with Rule 5 of The Tribunal Procedure (First-tier Tribunal)(Heath, Education and Social Care Chamber) Rules 2008, SEND Judges will issue directions relating to the composition of a panel in a particular case. The decisions will be facilitated by the use of case management conferences and consideration of the individual facts of a case.
